A federal court judge has settled the question over whether sweepstakes machines are really gambling devices after raids dating back to September 2012.
The man who is the chief distributor of the machines, Tracy Yoshimura of PJY enterprises, has argued that the machines are simply for entertainment.
The two sides were scheduled for trial next month, but on Wednesday federal judge Leslie Kobayashi granted the city’s motion for summary judgement.
In her ruling, she said that at the time of the three seizures of machines in the past – the use of the
product directs sweepstakes terminals, or PDS devices, constituted gambling.
The attorney for PJY Enterprises says he was disappointed in the ruling – and plans to appeal in the 9th circuit.
