Driver in Waikiki shooting had BAC more than twice the legal limit

A man who was shot and killed by a police officer in Waikiki had a high level of alcohol in his system.

According to the Honolulu medical examiner, Richard Nelson, 52, had a blood alcohol content of 0.206.

The legal limit for driving in Hawaii is 0.08.

Last Wednesday, police say an officer opened fire when Nelson tried to drive off after hitting a bus and a tree, nearly hitting the officer in the process.

The officer fired off five shots as a result.

Autopsy results revealed Nelson died from a gunshot wound to the chest.
