A 23-year-old man is facing a felony abuse charge in connection with an alleged assault in Liliha.
Police say Chauncey Bernabe physically assaulted his 18-year-old girlfriend Sunday morning in front of their two children, both under 14 years of age.
Bernabe was also arrested for interference with reporting an emergency or crime and four outstanding warrants.
He has yet to be charged.
Act 117 was signed into law by Gov. Abercrombie on 6/20/2014. The law amends §709-906 Abuse of family or household members; penalty and adds the following:
“Where physical abuse occurs in the presence of any family or household member who is less than fourteen years of age, abuse of a family or household member is a class C felony.”
The bill’s description:
“Requires a police officer to make reasonable inquiry of witnesses and the family or household member upon whom physical abuse or harm is believed to have been inflicted and order a no-contact period of forty-eight hours. Makes the commission of an act of physical abuse in the presence of a family or household member who is a minor under the age of fourteen a class C felony. (HB1993 CD1)”
