Tripler Army Medical Center has to pay $9 million to settle a medical malpractice case.

According to the lawsuit, a pregnant woman was taken to the hospital on Sept. 7, 2010. Her medical history was well-known to the staff, including her high risk of uterine rupture.

The lawsuit claims she was seen by an inexperienced physician in her first year of residency who failed to call for help when the woman’s uterus ruptured. Eventually an attending nurse called for help and a more experienced physician responded.

As a result, the lawsuit claims, oxygen was cut off to the baby, leaving him with brain damage and cerebral palsy.

The child is now permanently disabled and will need around-the-clock assistance for the rest of his life.

The family’s attorneys say a substantial portion of settlement funds have been used to purchase an annuity that will make monthly payments into the injured child’s trust that are guaranteed for the duration of his life, no matter how long he lives.
