Ask HPD: Tossing trash out of moving car

Question: I’ve seen people toss their trash out the window while driving. What’s the law?

Answer: Under state law, it is illegal for a person to throw, place, or drop litter from a vehicle on any highway.  Litter is rubbish, waste material, or debris of any kind – it doesn’t matter if it has value or not.  For example, tossing a cigarette butt or any type of food from a vehicle is considered littering.  A conviction for a first offense includes 4 hours of picking up litter or other community service, and subsequent convictions increase to 8 hours.  In addition, fines may range from $100 to $500.  Here are some tips to consider: Leave a trash bag in your vehicle or utilize an ashtray or water bottle until you can find a trash can.  Let’s keep our roadways clean by disposing of litter properly.
